GREEN-WAY® SUBSCRIBER AGREEMENT

This GREEN-WAY Subscriber Agreement (hereinafter referred to as the “Agreement”) is an official document that establishes your rights and obligations as a GREEN-WAY Subscriber. Please read its contents carefully.

1. REGISTRATION AS A SUBSCRIBER. TERMS OF USE. YOUR ACCOUNT

GREEN-WAY is an online service (hereinafter referred to as the “GREEN-WAY”).

After completing the registration of a GREEN-WAY user account (hereinafter referred to as the “Account”), you become a GREEN-WAY subscriber (hereinafter referred to as the “Subscriber”). This agreement comes into force after you accept its terms.

A. Subscriptions, Content and Services

As a Subscriber, you may access certain services and content available to GREEN-WAY Subscribers. The terms “Content” and “Services” in this Agreement mean the GREEN-WAY software client and any other software products, content and updates that you access using GREEN-WAY. The term “Subscriptions” in this Agreement means the rights to access and/or use the content and services that you access using GREEN-WAY.

Each Subscription entitles you to access certain content and services. Some Subscriptions may include additional terms and conditions specific to that subscription (the “Subscription Terms”). The Subscription Terms, Terms of Use, and GREEN-WAY’s Privacy Policy (located at https://green-way.com.ua/test-pdd/article/privacy_policy) become binding upon your acceptance of these terms and conditions or acceptance of this Agreement.

B. Your Account

After completing the GREEN-WAY registration process, you create your own account (hereinafter referred to as the “GREEN-WAY Account”). You may not disclose, transfer, or otherwise grant any third party the right to use your password or your Account. Each login to your Account using your username and/or password is deemed to be made by you, and you are responsible for this and for the security of your computer system. GREEN-WAY is not responsible for the use of your password and Account or for any interaction and activity on GREEN-WAY that resulted from the use of your username and password. You may not sell or grant for a fee the right to use your Account or otherwise transfer the right to use your Account.

2. PAYMENTS AND OTHER SUBSCRIPTIONS

All fees for using GREEN-WAY are paid in full in advance.

The Service will be provided immediately upon receipt of payment.

In some cases, GREEN-WAY may offer a free Subscription to certain services or content. As with paid Subscriptions, you are responsible for all Internet service provider, telephone and other charges incurred while connecting to GREEN-WAY, even if GREEN-WAY offers a free subscription.

GREEN-WAY may provide links to third-party websites. Some of them may charge additional usage fees that are not included in and are not related to the Subscription fee or other fees charged for using GREEN-WAY services. You are responsible for all additional costs and assume all obligations arising from your relationship with these vendors. GREEN-WAY assumes no obligations, direct or indirect, related to third-party websites. In particular, GREEN-WAY makes no warranties, express or implied, that services or subscriptions offered by third-party sellers will not be modified or suspended or discontinued.

REFUNDABLES

You may request a refund if you purchased a subscription in error.

GREEN-WAY will refund your money regardless of the circumstances if the refund was requested via info@green-way.com.ua no later than fourteen days after purchase and if you spent less than 30 minutes on the service. Even if your situation does not meet the described rules, you can still submit a refund request and we will consider the appeal.

The purchase amount will be fully refunded to you within a week after the return is approved and to the payment method you used during the purchase.

HOW TO SEND A REFUND REQUEST

You can submit a refund request and receive assistance in case of problems with purchases on the green-way.com.ua website by writing to info@green-way.com.ua or using the "Feedback" form.

3. ONLINE RULES OF CONDUCT, FRAUD ON THE SERVICE AND OTHER ILLEGAL ACTIVITIES

You agree to be personally responsible for the use of your Account with your username and/or password, as well as for any interaction and activity on GREEN-WAY. You also agree that GREEN-WAY is not responsible for the use of Your Account or any interactions and activities on GREEN-WAY that result from the use of Your Account. IfIf you believe that the confidentiality of your username and/or password has been violated, you must immediately notify GREEN-WAY using the technical support form.

Your behavior on the network and your relationships with other subscribers must comply with generally accepted standards of conduct.

The following are prohibited in the commenting system:
1. Post advertisements.
2. Spam.
3. Use obscene language.
4. Ask questions that are not related to the topic of the discussion.
Systematic violation of one of these points is punishable by blocking the account.

GREEN-WAY may use applications necessary to detect software or hardware resources that give the user an unfair advantage during testing (hereinafter referred to as the "Use of cheat codes in the service"). You hereby agree not to create or facilitate the creation and use of cheat codes in the service by third parties. You also agree that you will not directly or indirectly disable or otherwise interfere with the operation of programs that are responsible for detecting and preventing the use of cheat codes in the service. You agree that GREEN-WAY may deny you access to certain sections of the Service if you are found to be using cheat codes in connection with your use of GREEN-WAY or the Content and Services. You acknowledge that GREEN-WAY reserves the right to terminate your Account/Subscription without prior notice.

4. PROMOTION AND ADVERTISING

If you use GREEN-WAY to promote or advertise a third-party product, service or event for a fee (including non-monetary rewards), you must clearly disclose the source of such rewards to your audience.

5. TERM OF THE AGREEMENT AND TERMINATION CONDITIONS

A. Term

The Agreement shall be effective upon your clicking the “I agree” button and shall continue until terminated in accordance with the terms of this Agreement.

B. Termination at Your Initiation

You may terminate your Account at any time. You may terminate your use of a Subscription at any time by requesting GREEN-WAY to terminate your access to the Subscription.

C. Termination at GREEN-WAY’s Initiation

GREEN-WAY may terminate your Account at any time if (a) GREEN-WAY ceases to provide such Subscriptions to similar subscribers in a general manner or (b) you breach any term of this Agreement (including, without limitation, the Subscription Terms or the Terms of Use). If your Account or Subscription is terminated at the initiative of GREEN-WAY due to your violation of the provisions of the Agreement or illegal activity, you are not entitled to any compensation.

6. DISPUTE RESOLUTION

Most user problems can be resolved using GREEN-WAY support service.

You and GREEN-WAY agree to make reasonable, good faith efforts to resolve any dispute informally.

All disputes not regulated by this Agreement are governed by the provisions of applicable law.

7. MISCELLANEOUS

The current version of this Agreement was released on January 1, 2016 (hereinafter referred to as the "Date of Revision"). If You were a Subscriber prior to the Revision Date, this version replaces the existing GREEN-WAY Agreement upon Your express acceptance of the new version. You may continue to use GREEN-WAY in accordance with the terms of the previous version of the Agreement.
